Your submission will be considered by Council officers and may be used to update our draft documents. A report considering your feedback will also be presented to Council.

If Council wants to continue with the amendment and cannot include your suggested changes in the amendment, we will ask for an independent planning panel to:

• review our draft documents
• review feedback submitted and officer responses
• provide submitters the opportunity to present to an independent panel
• make recommendations on how to proceed.

Our levy will collect about 10% of the nominated projects cost. Other councils levies collect different amounts:

• Yarra 31.5%
• Darebin 24.3%
• Maribyrnong 31.6%.

We predict collecting about $7.8 million over 20 years.

The existing levy goes towards projects such as:

• traffic management improvements
• playground redevelopment
• shared user paths (pedestrian and cycling)

Because we can only fund projects listed in the plan, we needed to prepare a new one to collect levies for new projects such as:

• sporting pavilions
• library upgrades, and
• new community centres.

When we wrote the existing plan, we didn't know the need, location and cost of these projects and they were not identified in Councils 10 Year Capital Works Plan.

The projects we are funding are facilities that residents will use.

The State government requires us to calculate different levies for certain types of projects:

• Development Infrastructure Levy. This levy is related to a planning permit for development or subdivision and must be paid in accordance with the terms stated in the relevant permit.
• Community Infrastructure Levy. This can only apply to residential development. It must be paid before a building permit is issued.

While the new plan has both levy types we will only levy new residential development.

If approved, the levies will apply from the date that Amendment C214 is published in the Victorian Government Gazette.

Levies do not apply to:

• renovations or alterations to an existing dwelling;
• demolition and construction of a replacement dwelling
• outbuildings normal to an existing dwelling and fences
• replacing buildings that were unintentionally damaged or destroyed
• land developed for a non-government school.

Social Housing built by or on behalf of the Department of Families, Fairness and Housing is also exempt.

It applies to all areas in the City of Brimbank except for the Sunshine Metropolitan Activity Centre as it has its own Development Contributions Plan 2014.

It uses the current levies. We will update the levies if this Amendment is approved.

We update the levies at the beginning of each new financial year to reflect inflation. We do this by applying

• Consumer Price Index to Development Infrastructure Levy
• Producer Price Index to Community Infrastructure Levy.
